Terms of Use

These Terms of Use govern your access to and use of the Sites. By accessing, browsing, contributing information to, or using Real Boat Prices in any way, you agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, do not use the Sites or Services.

Real Boat Prices reserves the right to update or modify these Terms of Use at any time, with or without prior notice. Changes become effective upon the earlier of (i) your first use of the Sites with actual notice of the change, or (ii) 30 days after the change is publicly posted. Your continued use of the Sites after updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law. We encourage you to review these Terms of Use periodically.

Real Boat Prices is an informational platform designed to collect, aggregate, analyze, and present boat transaction information and market insights. The service may include information such as transaction prices, asking prices, MSRP information, discounts, model information, geographic information, market trends, statistics, aggregated benchmarks, estimates, charts, rankings, and other insights derived from contributed or otherwise lawfully obtained information.

Real Boat Prices is an independent informational resource. It is not a boat dealer, broker, appraiser, lender, financial advisor, or party to any transaction between buyers and sellers.

All transaction information, pricing information, statistics, averages, medians, percentages, discounts, trends, benchmarks, estimates, charts, rankings, analytics, and other insights available through Real Boat Prices are provided solely for general informational and educational purposes.

Nothing provided by Real Boat Prices constitutes or should be interpreted as:

• buying advice or selling advice;
• financial advice or investment advice;
• an appraisal or a professional valuation;
• a recommendation to purchase or sell any boat;
• a recommendation regarding what price a buyer should offer or pay; or
• a recommendation regarding what price a seller should ask for or accept.

Users are solely responsible for conducting their own research, inspecting boats, evaluating transaction terms, consulting appropriate professionals when necessary, and making their own buying and selling decisions.

Individual boat values can vary substantially based on condition, engine hours, options, equipment, maintenance history, damage history, location, seasonality, warranty, dealer involvement, transportation costs, taxes, financing, economic conditions, market conditions, and numerous other factors. Historical transaction information does not establish the value of another boat and does not guarantee present or future transaction prices.

Real Boat Prices collects information from users and potentially other lawful sources. Real Boat Prices does not independently verify every transaction or data submission. Although Real Boat Prices may use processes designed to identify inaccurate, duplicate, fraudulent, misleading, manipulated, or unusual submissions, it cannot guarantee that all such information will be identified or removed.

The dataset may contain errors, omissions, inaccuracies, incomplete information, reporting errors, sampling bias, or fraudulent submissions. Real Boat Prices does not represent that its dataset contains all boat transactions or is statistically representative of the entire boat market. Certain manufacturers, models, geographic areas, model years, transaction types, price ranges, or other categories may be disproportionately represented. Statistics and insights may change as additional information is received or methodologies are modified.

Users should not assume that the dataset represents every boat transaction or the entire boating market.

Users assume full responsibility for decisions they make using information obtained through Real Boat Prices. To the fullest extent permitted by applicable law, Real Boat Prices is not responsible for losses or alleged losses resulting from:

• purchasing a boat for more than a user believes it was worth;
• selling a boat for less than the user believes it was worth;
• rejecting an offer, making an unsuccessful offer, or missing a transaction opportunity;
• relying upon a particular transaction, statistic, estimate, or insight; or
• experiencing a different market outcome than information on Real Boat Prices may have suggested.

This provision complements and does not replace the broader limitation of liability set forth in Section 13.

You may be required to register and create an account to access some content and functionality on the Sites. You are responsible for maintaining the confidentiality of your account, password, and other information. By creating an account, you agree that such account is intended for your use only. You agree to notify Real Boat Prices immediately if you become aware of any unauthorized access to or use of your account. Real Boat Prices may disable an account at any time in its sole discretion.

Any information you provide to Real Boat Prices must be correct, current, and complete. Our use of your information is governed by our Privacy Policy.

Users who submit transaction information represent that, to the best of their knowledge, the information they provide is truthful and accurate. Users may not knowingly submit false, fraudulent, misleading, fabricated, defamatory, unlawful, or intentionally manipulated information. Users should not submit confidential information, personally identifiable information about another person, or information they do not have the right to provide.

Real Boat Prices may review, exclude, correct, normalize, aggregate, anonymize, or remove submissions at its discretion for data quality, security, legal, analytical, or operational purposes.

You retain ownership rights in and to your User Content to the extent you hold such rights. By submitting information to the Sites, you hereby grant Real Boat Prices a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license, to the extent permitted by applicable law, to:

• host, store, reproduce, modify, normalize, aggregate, and anonymize submitted information;
• analyze it and create statistics, benchmarks, estimates, and derivative insights from it;
• incorporate it into proprietary datasets and combine it with other information;
• create reports, analytics, market intelligence products, and other derivative works from it;
• commercially use and monetize aggregated or derived information; and
• include aggregated or derived information in subscriptions, licensing arrangements, APIs, commercial reports, or other products and services.

Users should understand that contributing transaction information may ultimately contribute to commercial Real Boat Prices products. Real Boat Prices does not claim ownership of intellectual property that a contributor does not have the legal ability to transfer or license.

The Real Boat Prices website, software, branding, designs, graphics, reports, charts, analytics, methodologies, and the proprietary compilation, selection, coordination, organization, arrangement, and presentation of information and other original content are owned by or licensed to Real Boat Prices and are protected by applicable intellectual property and other laws.

The fact that individual factual transaction data may not itself be proprietary does not grant users permission to copy, reproduce, extract, scrape, compile, or redistribute the Real Boat Prices database, its proprietary compilation or presentation, or substantial portions of the information available through the service.

Users may access information displayed through Real Boat Prices for reasonable personal use subject to these Terms of Use. Accessing the Sites does not grant users ownership of or unrestricted rights to the Real Boat Prices database, compilation, analytics, or content.

Unless Real Boat Prices provides prior written authorization, you may not:

• scrape, crawl, spider, harvest, extract, download, copy, or systematically collect information from Real Boat Prices;
• use bots, scripts, browser automation, automated agents, artificial intelligence agents, scraping tools, data mining software, or similar technologies to access or collect information from the Sites;
• circumvent rate limits, access controls, technical restrictions, robots directives, authentication systems, or other measures designed to limit automated or bulk access;
• systematically collect information manually for the purpose of recreating, compiling, or maintaining a database derived from Real Boat Prices; or
• make bulk requests designed to extract substantial portions of the information available through the service.

Normal browsing and reasonable personal use of the Sites are permitted. Users may share limited excerpts or individual insights for ordinary non-commercial purposes, provided the use does not substitute for the Real Boat Prices service, does not involve systematic collection, and appropriately identifies Real Boat Prices as the source.

Unless Real Boat Prices provides prior written permission, you may not reproduce, republish, redistribute, sell, license, sublicense, syndicate, commercially exploit, or otherwise make substantial portions of Real Boat Prices information available to another person or organization. Access to publicly viewable portions of the Sites does not constitute permission to commercially exploit the underlying data.

Real Boat Prices may separately offer commercial subscriptions, data licenses, APIs, reports, analytics, or other commercial products. Businesses, dealers, manufacturers, brokers, lenders, insurers, researchers, software companies, data companies, and other organizations interested in using Real Boat Prices data commercially should contact us at realboatprices@gmail.com regarding licensing or authorized access.

Without prior written authorization from Real Boat Prices, you may not use information obtained through the Sites to create, populate, enhance, validate, benchmark, maintain, or operate:

• a competing boat pricing database or boat valuation service;
• a boat transaction database or market intelligence product;
• a commercial dataset or another website or application substantially reproducing Real Boat Prices information;
• an artificial intelligence or machine learning dataset, model, system, product, or service using Real Boat Prices information for training, fine tuning, grounding, retrieval, evaluation, validation, or similar purposes; or
• a commercial analytics product derived substantially from Real Boat Prices information.

You may not systematically collect Real Boat Prices information for the purpose of reverse engineering or recreating the Real Boat Prices dataset, analytics, methodologies, or commercial products.

To the fullest extent permitted by applicable law, the Sites, Services, information, data, statistics, analytics, estimates, and other content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Real Boat Prices does not warrant that information will be accurate, complete, current, representative, reliable, uninterrupted, or suitable for any particular transaction or purpose. Real Boat Prices makes no warranties or representations regarding merchantability, fitness for a particular purpose, or non-infringement.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

To the fullest extent permitted by applicable law, Real Boat Prices and its owners, operators, affiliates, employees, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of or reliance upon the Sites or Services.

Without limiting the foregoing, Real Boat Prices is specifically not liable for claims involving:

• paying more for a boat than you otherwise might have paid;
• selling a boat for less than you otherwise might have received;
• missed buying or selling opportunities or unsuccessful negotiations;
• differences between Real Boat Prices information and actual transaction outcomes, dealer quotes, appraisals, lender valuations, insurance valuations, listing prices, or other valuation sources;
• inaccurate, incomplete, fraudulent, outdated, manipulated, or unrepresentative data; or
• market conditions changing after information was collected or published.

Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of these limitations may not apply to every user.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Real Boat Prices and its owners, operators, affiliates, employees, contractors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use, your misuse of the Sites or Services, your unlawful conduct, or information you submit without appropriate rights. This provision applies to conduct directly related to your use of the Sites and is not intended to impose liability for conduct unrelated to the service.

You agree that you will not post any User Content that (a) infringes on or violates any intellectual property rights, (b) fails to comply with applicable laws and regulations, or (c) contains any expressions of hate, abuse, offensive images or conduct, or any similar content. Without limiting the foregoing, User Content must not:

• contain any defamatory, libelous, obscene, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable material;
• promote violence or discrimination based on race, ethnicity, sex, religion, nationality, disability, sexual orientation, gender identity, or age;
• violate any person's or entity's legal rights (including intellectual property rights and rights of publicity and privacy);
• impersonate any person or entity or misrepresent your identity or affiliation;
• be likely to or designed to deceive any person or entity;
• contain any material that is unlawful or could result in civil or criminal liability;
• involve commercial activities or sales other than as conducted by Real Boat Prices in its operation of the Sites; or
• conflict with these Terms of Use or any other applicable law or policy.

You may not use Real Boat Prices in a manner that violates applicable law, interferes with operation of the service, attempts unauthorized access, introduces malicious software, overloads infrastructure, impersonates another person, manipulates submissions, compromises data integrity, or otherwise harms Real Boat Prices or its users. Real Boat Prices may restrict, suspend, block, or terminate access for users or systems that violate these Terms of Use.

Real Boat Prices reserves the right to investigate suspected scraping, unauthorized extraction, systematic collection, redistribution, commercial exploitation, or other violations of these Terms of Use. Real Boat Prices may use reasonable technical and legal measures to protect the service, including restricting, suspending, or terminating access. Unauthorized use may result in legal action where appropriate.

The Sites may contain links to third-party websites, advertisements, services, or resources. Real Boat Prices does not control and is not responsible for the availability, accuracy, content, products, privacy practices, security, or services of third parties. Users access third-party resources at their own discretion.

If you believe that content available through the Sites infringes your intellectual property rights, please contact us at realboatprices@gmail.com with a description of the claimed infringement and the relevant content.

Your use of the Sites is also governed by our Privacy Policy.

Real Boat Prices may modify, add, remove, suspend, restrict, or discontinue features, data, analytics, access methods, or portions of the service at any time. Real Boat Prices does not guarantee that any particular feature, dataset, statistic, or insight will remain continuously available.

All matters relating to the Sites and these Terms of Use, and any dispute or claim arising therefrom or related thereto (including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Minnesota without giving effect to any choice or conflict of law provision or rule.

If any provision of these Terms of Use is determined to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect to the extent permitted by law.

These Terms of Use, together with the Privacy Policy and any other expressly incorporated policies or additional terms, constitute the entire agreement between you and Real Boat Prices governing your use of the Sites and Services, and supersede all prior agreements and understandings.
